Terms of Use

Under the Terms of Use, all visitors of the website qualify as Users.

User shall update the personal data provided as may be necessary to ensure that they are up to date, comprehensive and valid.

A significant portion of the contents of the website is available for all Users, even without registration. However, certain services require registration (and then logging in), and certain services are available subject to purchasing the software product(s) licensed by Service Provider (e.g. support services).

User shall be solely liable for keeping the password belonging to the user name in secret.

The usage of all systems or means aiming at or possible having the effect of shutting down the servers used for operating the website, or otherwise jeopardizing the operation of the website or any service provided via the website, are prohibited.

User shall ensure not to infringe, either directly or indirectly, the rights of third persons or the laws in the course of using the website.

Service Provider reserves the right to temporarily or permanently disable User’s access to the service, or to suspend or delete User’s registration, together with all related data, without a prior warning or notification, in case that User breaches the requirements of this Terms of Use or otherwise uses the service in a malicious manner.

In the webshop accessible via the website, User may select the product wished to be purchased, and following the compilation of the order may finalize his/her order. Prior to finalizing the purchase, User may review the information provided, and, if he/she does not wish to amend the order or modify its data, may finalize the purchase order. Service Provider shall confirm the order within 48 hours following the receipt of the order.

Taking into account the purpose of the software sold via the website and the website in general, Service Provider works under the assumption that the customers of the website do not qualify as consumers, since Users are proceeding within the scope of their economic or professional activities. By making a purchase via the website, User declares that in respect of the purchase he/she does not qualify as a consumer. Should the User intend to purchase the product for a purpose falling outside the scope of his/her economic or professional activities, he/she shall inform the Service Provider thereof in advance. Taking into account the special requirements pertaining to consumer contracts, such purchases may not be placed via the webshop.

Exclusively User shall be responsible to pay any tariffs or customs payable after the sale of the product in the User’s country. User shall ensure that the product sale and purchase fully complies with all import regulations or any other similar regulations applicable in User’s country. Should this require any declaration made or action taken by the Service Provider, User shall notify Service Provider thereof in due time in advance.

The information on the website has been placed in good faith, however, these serve informative purposes only. The website only provides a useful aid in professional questions of tooth aesthetic operations. Such information cannot be relied on for purposes beyond this informative purpose; Service Provider does not undertake any liability for the accuracy, comprehensiveness of such information.

Neither Service Provider, nor any of its employees or subcontractors will undertake any liability for any losses, damages, expenses (including, without limitation, any lost profit, indirect, collateral or consequential losses as well) that may incur as a result of visiting or usage of the website. User may use the website exclusively at his/her own risk, and accepts that beyond liability for breach of contract caused willfully, by gross negligence or by a felony offense, or damaging life, physical integrity or health, Service Provider excludes all liability for any pecuniary or non-pecuniary damage incurred in the course of usage.

Service Provider excludes all liability for the activities of the users of the website. User shall be fully and exclusively liable for his/her own activity; in such cases, Service Provider will fully cooperate with the proceeding authorities to facilitate exploration of any breaches of law.

The website of the service may contain linking points (links) leading to other service providers' websites. Service Provider excludes all liability for the data processing practice, and other activities of such service providers.

Service Provider is entitled, but not obliged to monitor the contents made available by the Users, if any, in the course of using the website. In respect of the contents published, the Service Provider is entitled, but not obliged to search for indications of unlawful activities.

Service Provider excludes all liability for any operation or content errors or defects that may occur incidentally, directly or indirectly, in the course of visiting the website. Furthermore, Service Provider does not assume any liability for any errors occurring as a result of the provision of incorrect data.

Due to the global character of the Internet, User undertakes to proceed in compliance with the provisions of all applicable national measures in the course of using the website. If any activity related to using the website is not permitted according to the laws of User's country, User shall exclusively bear responsibility for such usage.

Should the User become aware of any questionable contents on the website, he/she shall promptly notify the Service Provider. If the Service Provider, in its good faith procedure finds such a notification well-grounded, it is entitled to promptly delete or modify the information in question.

The website falls under copyright protection. Service Provider is the copyright holder or the authorized user of all contents displayed on the website and in the course of providing the services accessible via the website: any copyrighted works or other intellectual property (including, among others all graphics and other materials, the layout, the structure of the surface of website, the software and other solutions, ideas, implementations used).

All trademarks (brand names, logos etc.) are owned or licensed by Service Provider. Neither registration or using the website, nor any provisions of the Terms of Use provide User any right to use or utilize any commercial names or trademarks of Service Provider.

Beyond displaying as part of normal use of the website, as well as any temporary reproduction or private copying necessary thereto, such intellectual properties may not be used or utilized in any other form or manner without the prior written consent of Service Provider. User may study the website, create an extract copy thereof by means of printing, saving to a disk and transferring to another person; however, all such uses shall exclusively be for a personal, informative purpose, may not serve commercial purposes, and shall involve the name and contact information of Service Provider in connection with all such uses. No copies of parts of the website may be sold or transferred for a commercial profit, and no parts of the website may be amended or incorporated into another work or publication, website, either electronically or in any traditional manner. Beyond those stipulated herein, Service Provider grants no authorization or rights to User in relation to the website, the contents accessible via the website.

Service Provider reserves the right to make any amendments, corrections on the website at any time and in any manner, without a prior warning. Furthermore, Service Provider reserves the right to relocate the website to under another domain name.

Service Provider maintains the right to modify the present Terms of Use unilaterally. User accepts the amended Terms of Use by the first use of the website following the entry into force of such amendment.

User acknowledges that even if Service Provider has had the English version of the Terms of Use translated to other languages, this was done for the convenience of users only, and even in such case the English language version shall prevail as terms and conditions of using the website. In case of any inconsistency between the English language Terms of Use and any other language version, the English version shall prevail.

This Terms of Use, as well as the website and all services of Service Provider in general shall be governed by the effective laws of the Hungarian Republic. In case of any legal disputes arising from the legal relationship, the Pest Central District Court or the Metropolitan Court of Budapest shall have exclusive jurisdiction.

The fact that Service Provider does not exercise any of its rights provided by law may not be considered as a waiver of exercising the given right and/or enforcing the claim.

The language of the contract concluded by means of accepting the Terms of Use shall be English, such agreements do not qualify as contracts put in writing, and they are not filed by Service Provider.

The agreement concluded by and between the Service Provider and the User based on the present Terms of Use shall be terminated if User deletes his/her registration, or if Service Provider deletes User’s registration.
